Privacy Policy (effective as at August 31, 2021)

Next Buzz Media Ltd. (NBM, “we” or “us”) produces this privacy policy to promote end users’ privacy and is committed to protecting users’ online privacy. This document applies to our corporate website, www.nextbuzzmedia.com (the “Site”) and our audience intelligence and analytics service (the “Service”) and how we collect and use end users’ data. This policy applies whenever you access or use the Site or a mobile application that is connected to the Services.

Our Services

We operate an audience intelligence platform and provide services to our Customers (the “Customer”), such as app developers, publishers, marketers, agencies, and other companies, to collect, organize, and activate data for marketing, precise advertising, cross-app advertising, analytics, data modelling, data linkage (onboarding), and device linkage purposes. NBM’s technology platform, the NBM AIP, empowers our Customers to deliver and measure personalized services and relevant contents to end users.

Our Customers are required to comply with our Privacy Policy in relation to data collection and advertising practices.

Membership

NBM is a member of the Network Advertising Initiative (NAI) and adheres to the NAI Code of Conduct as described on the NAI website. NAI is a non-profit organization that is the leading self-regulatory association dedicated to responsible data collection and applications.

Data Collection and Use

NBM collects information from a variety of sources through three general channels:
  • Direct Channel: You have direct interaction with us or through other activities such as account creation, submission of registrations and forms, or sales inquiries and transactions.
  • Automated Channel: We use online technologies such as software development kit and server-to-server connections with our Customers and Partners to collect and store data.
  • Publicly Available Data & Third-Party Data: We collect data from Automated Channel on non-NBM websites, or other data you may have made publicly available, such as public posts and comments, or data provided by third party sources, such as marketing opt-in lists, credit card company, credit bureau, location data aggregators, or street address associated information.
Identifier: We collect identifiers such as mobile advertising ID, pseudonymous ID, and other Personally Identifiable Information (“PII”) from your internet-connected device. PII is information that can be used to identify an individual user, for example, a person’s name, home address, email address, IP address, phone number, mailing address, Unified ID 2.0, and other similar online IDs, for the purpose of Audience Matching Advertising (AMA). NBM collects, organizes and shares Identifiers only with your explicit consent when you register, checkout, or enter data into a website or an application via Direct or Automated Channel.

Device and Viewed-content Data: Customers that use our Service to track the use of their internet-connected applications, including but not limited to applications for mobile, desktop, and connected TV, will provide us with information regarding the characteristics and activities of their end users, including information regarding downloads and installations of such applications and any information regarding in-app events such as in-app purchases. NBM obtains this information as a result of data being sent to our servers from our or our Partner’s SDK in an end user’s internet-connected application. The data collected by the SDK includes information such as IP address, user agent, user declared age and gender, platform, SDK version, time stamp, developer Key, application version, device model, manufacture, OS version, in-app events, network status (WiFi, 3G, 4G & 5G), installed app information, motion sensor data (magnetic field, gyroscope, accelerometer), user Identifier(s) and device identifier(s), such as: IDFA (Identifier For Advertisers), Android ID (Android device), Google Advertiser ID, connected TV ID.

In certain instances, our Customers may choose to connect and integrate our Service with third parties that have partnered with NBM. In such instances, information collected and processed may be provided to both the Customer and their partner networks.

NBM also collects and organizes IP addresses for the purpose of cross-device linkage, but we will not share this information to any third party. However, if users send PII to us in an email or voluntarily provide PII to us in Direct Channel, we will receive and store such information.

Precise Location Information: We may collect and process precise location information from your internet-connected device through partners, including mobile app owners and mediation platforms. We use various technologies, GPS, and other sensors, to determine nearby points of interest (POIs) and high level location characteristics. Precise location information collected through our technology includes but is not limited to device type, advertising IDs (IDFA and Android ID), browser type, operating system, and IP address. We use such information to help Customers deliver you with personalized location-based services or content. You are notified at the time of consent for the collection of such information, and you may be permitted to allow or deny such use of your device’s location. If you choose to deny such use, we may not be able to provide you with the applicable personalized services or content.

Other Data: We may also collect information submitted on order forms and website registrations and interests expressed or implied through your internet-connected device, or the application that you use, and infer your purchase behavior from the types of products purchased and the frequency and recency of purchase.

Google Analytics: The Site uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which is a small text file that is stored on your web browser for record-keeping purposes. The cookie can be accessed by web servers to uniquely identify a browser when you return to the Site. A cookie file may contain information such as an pseudonymous user ID that is associated with browser information, IP address and browsing behavior. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. On behalf of NBM, Google will use this information for the purpose of evaluating your use of the Site, compiling reports and providing other services relating to website activity and internet usage. You may refuse the use of cookies by selecting the appropriate settings on your browser. However, please note that if you do this, you may not be able to use the full functionality of the Site. You can refuse the use of Google Analytics by clicking on the following link (https://tools.google.com/dlpage/gaoptout?hl=en). An opt-out cookie will be set on the computer, which prevents the future collection of your data when visiting the Site.

Data Sharing

As part of the NBM Service, NBM shares data with our Customers which are listed in our “Appendix: Partner List”. NBM aggregates the data collected and derives aggregated audience insights in the form of “Audience Segments”. Then, our Customers are able to use Audience Segments for marketing, precise advertising, cross-app advertising, analytics, data modelling, data linkage (onboarding), and device linkage purposes.

NBM shares data to our affiliate and third party service providers who provide cloud data storage, data processing, and other operational support to the NBM Service. These service providers are subject to confidentiality restrictions and are not authorized to use, access, or transform NBM’s data for any purpose other than providing their services to NBM.

There is also the possibility that NBM, or part(s) of the company, may one day be purchased by, or merged with, another company. If that’s the case, the acquiring (or merging) company will have access to information we have previously collected.

Finally, we may release PII when we believe in good faith that release is necessary to comply with a court order or to cooperate with government and law enforcement officials, enforce or apply our conditions of use and other agreements, or protect the rights, property or safety of NBM, our employees, users, or others.

Data Transfer, Security & Protection

NBM works with global companies, customers, and partners, and we may need to transfer, store, and process data in multiple data centers located internationally. When we transfer data to or from the European Union to non-European Union countries, we follow the standard Model Clauses and/or another cross-border data transfer mechanism, such as Privacy Shield.

NBM takes appropriate security measures to safeguard information in our possession against unauthorized access, unauthorized alteration, disclosure or destruction of data. Our security measures include physical security, appropriate encryption and restricted access to guard against the unauthorized use of data or information.

Any data that is stored on NBM’ servers is treated as confidential and is not generally available to the public. NBM has an internal security policy with respect to the confidentiality of customer and other data, limiting access only to those employees who we reasonably believe need to know such information for the purpose of performing their jobs. However, no method of transmission over the Internet is completely secure. Therefore, we strive to use commercially acceptable means to protect PII without guaranteeing its absolute security. We retain the collected data for no more than 360 days. Then, we archive the data for internal performance analysis for an addition of 360 days.

Protecting Children

NBM concerns about children’s privacy. We do not intentionally collect any PII from children under the age of (16) sixteen. However, if you believe your child has provided any PII to us, please contact us at privacy@nextbuzzmedia.com.

Opt-Out

Resetting Advertising ID from mobile devices may prevent the customized user experience on most mobile applications and websites. Additionally this will not prevent all online behavioral advertising as you will continue to receive advertisements that are not targeted or relevant to you.

You can opt-out of targeted advertising on mobile by enabling “Limit Ad Tracking” setting on iOS mobile devices and “Opt out of Ads Personalization” setting on Android devices.

To enable Limit Ad Tracking for Apple devices:

Go to Settings > Privacy > Advertising, then turn ON “Limit Ad Tracking”.

To enable Opt out of Ads Personalization on Android devices:

Go to Settings > Google > Ads, then turn ON “Opt out of Ads Personalization”.

Besides, you have your right to opt-out from having NBM collect your Non-PII, please enter your advertising ID in the following box to opt-out directly.

In order to find your Apple advertising ID (“Identifier for Advertisers” or “IDFA”), a third party tool is required. There is a wide selection of apps with the capability on the App Store. Below are a selection of apps for iOS that can show a device’s IDFA to users.

To find your Android Advertising Identifier, open the Google Settings app on your Android device and click on “Ads.” Your Advertising Identifier will be listed at the bottom of the screen.

Following such restart, the device is harder to associate with past activity, but tracking can start anew using the new advertising identifier.

You may also choose to opt-out from interest-based advertising via Network Advertising Initiative (NAI) http://optout.networkadvertising.org/?c=1.

To enable Opt out of Ads Personalization on TV Streaming devices:

Regarding cross-device linkage, NBM may associate identifiers that come from OTT devices and advertising IDs for the purpose of personalized advertising. You will need to individually opt-out all devices.

To enable Opt out of Ads Personalization based on Personal Identifiable Information:

Regarding email address, you can opt-out of targeted advertising based on your email address via the NAI Audience Matched Advertising Opt Out (Beta) at https://optout.networkadvertising.org/optout/email.

Alternatively, you can email privacy@nextbuzzmedia.com to request an opt-out of targeted advertising. Please note that the sender's email address should be the same as the intended opt-out email address so that we can verify the email owner and the selected option.

To enable Opt out of Ads Personalization based on street addresses:

Regarding street addresses, NBM may collect information, for example, census data, that associates with aggregated street addresses or household areas, for the purpose of personalized advertising. To opt-out, you can email privacy@nextbuzzmedia.com to request an opt-out of targeted advertising. Please note that you will need to enter your street address in the email.

Legal Basis for Processing Data of a Data Subject in California

If you are a resident of the California, under the California Consumer Privacy Act (CCPA), you may have the right to request NBM to disclose what information we collect, use, disclose or sell about you, to access the specific pieces of information we hold about you, and/or request us to delete any of your personal information we collect or maintain, subject to certain exceptions. To request for information or deletion, please email privacy@nextbuzzmedia.com. You may also appoint an authorized agent to make the request on your behalf. If you choose to do so, the agent will be required to provide proof that they are authorized by you, and we may ask you to verify your identity and to confirm that you have given the agent the permission to submit the request on your behalf. The data we are collecting only include device identifiers. We do not hold any information that will let us identify you personally, such as your name or email address. If you are requesting deletion or access of data, we will require you to provide evidence that the pseudonymous data relates to you (and only to you), and may deny your request if you cannot provide such information. Please note that if you wish to exercise any of your rights with NBM’s clients or partners, you must make your request directly with those clients and partners.

Legal Basis for Processing Data of a Data Subject in the EEA

If you are a resident of the European Economic Area (EEA), NBM’s legal basis for collecting and processing the data described in the above “Data Collection and Use” section will depend on the data concerned and the specific context in which we collect and process it.

Consent: We collect and process data from you to fulfil contractual services to you only where we have your consent on the Site, NBM’s own compliance procedures, or through our partners’ compliance procedures.

Legitimate Interest: We rely on legitimate interests to communicate with our Customers about our Services. We also rely on legitimate interests for fraud prevention and detection, provided these interests are not overridden by your data protection rights.

Your Data Protection Rights

If you wish to access, correct, update or request deletion of your personal information, you can do so at any time by contacting us at privacy@nextbuzzmedia.com.

In addition, if you are subject to European Data Protection Regulation, you can object to processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information. Again, you can exercise these rights by contacting us at privacy@nextbuzzmedia.com.

Privacy Policy Updates

NBM reserves the right to update this Privacy Policy anytime. Previous versions will be archived for review. Please review it frequently and contact us at privacy@nextbuzzmedia.com if there are any complaints or further questions related to this policy.
